Chapter 7 is often called the "Fresh Start" Bankruptcy
appropriate for people who have little or no disposable income
and bills they cannot pay. If your income is
completely exhausted after paying your basic living expenses and
you have substantial debt, Chapter 7 may be an option for you.
The Bankruptcy Code may allow you to keep all of your personal
property and your residence while discharging many debts
including credit cards, unsecured lines of credit, medical bills
and other obligations. Upon filing, you will be protected
from creditor harassment, repossession and garnishment by the
automatic stay provided by the Bankruptcy Code.
Although Congress passed a substantial reform bill in 2005, the
majority of individuals who truly need protection and relief
from their debts are still able to file for either Chapter 7 or
Chapter 13 Bankruptcy.
