CHAPTER 7 BANKRUPTCY  -  CHAPTER 13 BANKRUPTCY

1.     CHAPTER 7 BANKRUPTCY FEES

         Bankruptcy Court Filing Fee: $338.00 (may be paid after filing through installments to the Court if approved + fees for the mandatory counseling/debtor education programs ($10 - $20 each).

         Bankruptcy Attorney's Fee:    (PLEASE CALL - I WILL QUOTE A FEE AFTER HEARING YOUR SPECIFIC CIRCUMSTANCES)

   From $995.00 for most non real-estate consumer cases
            $1295.00 - simple consumer Chapter 7 if you own real estate

If you own a business, please call for a quote and consult.

+ Reaffirmation Agreement charge - $200 (not mandatory- by request only)

        Flat fees are standard in consumer Chapter 7s, and I have recently elected to offer a low $995.00 flat fee for most non real-estate consumer cases, or $1295.00 if you own real estate.   Please call for a quote and I do make exceptions based upon your specific circumstances.    Business owners please call for a free consult and quote.          

      Although I generally feel that reaffirmation agreements are not in the best interests of my clients, if you elect to reaffirm a debt I will also add a $200 fee - no additional charge if you do not reaffirm.  Reaffirmations are not required, but may be necessary to retain a vehicle with some lenders.   When you retain me, I will generate a written fee agreement that you will have an opportunity to review prior to paying any fees.  

     I do have payment plans available starting with a $200 down payment, and will start taking your creditor calls as soon as you retain my office, but generally will not file the Bankruptcy for you prior to the attorney fee being paid for Chapter 7.   My fee includes representation at the mandatory 341a meeting of creditors and remaining as your attorney of record until you receive your discharge.  I will be available to you as your personal attorney to answer your bankruptcy questions from start to finish.   I can be reached directly at 425-996-4145 or 206-569-4685 or by email at tom@tomlaw.com , and I will personally return your call or email if I am temporarily unavailable.   Getting you through the Bankruptcy process as painlessly as possible is my primary concern.

    Fees for adversarial matters, motions for relief from stay or discharge contests or related matters are not included and if required are subject to an additional fee agreement and retainer.  Please call for details.

   

2.     CHAPTER 13 BANKRUPTCY FEES

        Bankruptcy Court Filing Fee: $313.00 (can usually be paid by Trustee after filing if application approved.  You must also pay for the mandatory counseling/debtor education programs. ($10 - $20)

        Attorney's Fee: (generally paid later through Plan):  Set pursuant to U.S. Trustee Guidelines

        If you have wage, self-employment or fixed income and are a first time filer, I can usually file your Chapter 13 Bankruptcy immediately and provide you with protection from your creditors with no attorney fees up front.  You will need to take and pay for the mandatory credit counseling first. (one hour online - $15-$20 fee)  If you have a business, or prior bankruptcy history, I may request a retainer in advance of filing.   Your monthly Plan Payments to your Bankruptcy Trustee in Chapter 13 generally include all attorney's fees which I am requesting pursuant to the U.S. Trustee Guidelines.   Fees in Chapter 13 are subject to Court approval, and if additional work and fees are required, I will petition the Court to allow additional fees.  Please contact my office if you have any questions concerning this fee schedule or the Bankruptcy process.  Phone consults are free.
